Booking Terms and Conditions - Private Guided Walks
These terms and conditions govern the relationship between you and Great British Escapes Limited trading as Muddy Boots Walking Holidays (“Muddy Boots”). It is important that you read these terms and conditions carefully as they form a binding contract between you and Muddy Boots and include some limitations and exclusions of liability.
1. Booking and Payment
Full payment is required prior to your Muddy Boots Discovery Walk (“the walk”) to secure your booking. Once we receive your payment and completed booking forms the contract between us will become binding.
All participants must be aged 18 years or over, unless accompanied for the duration of the walk by a parent or legal guardian.
2. Participation statement and Personal Insurance
Our walks are adventurous activities with a risk of personal accident and/or injury. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement. Please ensure that you are aware of the levels of physical activity that will be undertaken during your walk, and that you are suitably equipped.
Muddy Boots accept no responsibility for personal accidents or injury or for loss or damage to personal effects.
We strongly recommend you have adequate personal insurance cover for accident or injury, as well as travel insurance in case of cancellation. It is your responsibility to ensure that the insurance cover you purchase is adequate.
All personal equipment is, at all times, carried at your own risk. We will not be responsible whatsoever for any loss of or damage to your personal equipment. We therefore recommend that your insurance policy includes cover for personal items.
3. Cancellation
Any cancellation must be notified in writing by the person who made the booking. If, after booking the walk, you would like to change to an alternative date, we will seek to accommodate any reasonable request at no additional cost (subject to availability).
Cancellations will be subject to the following charges / refunds:
Days in advance of the walk Cancellation Fee
More than 14 days Full Refund
Between 14 and 2 days 50% of the walk cost
Less than 2 days 100% of the walk cost
4. Changes or Cancellation by Muddy Boots
In the event of cancellation by Muddy Boots, you will receive a full refund of all monies paid to us. Liability is limited to the cost of your walk only. As above, we recommend you have adequate travel insurance in case of cancellation.
We reserve the right to cancel the walk, or amend the walk route, at any point as we deem appropriate. If a major change becomes necessary in advance of the walk, we will inform you as soon as reasonably possible. It may be that cancellation of the walk or changes to the route (either before or during the walk) are required due to adverse weather conditions, fitness, injuries etc.
5. COVID-19
Please ensure that you are aware of the government guidelines regarding COVID-19, including those relating to social distancing, personal hygiene, testing and reporting health issues.
If you have any of the recognised symptoms of COVID-19 you must follow the guidance in place from the government and not attend the walk.
You acknowledge that undertaking any activity while the virus is still active is increasing your risk of infection and, whilst we will take all reasonable steps to minimise the risk of transmission, Muddy Boots has no liability for any related losses, costs, expenses or other sums of any type.
Walks may need to be changed or cancelled as a result of ongoing COVID-19 disruption, government advice, or other reasons beyond Muddy Boots’ control and we reserve the right to do so.
6. Data Protection
By making a booking with Muddy Boots you agree to Muddy Boots using your information and passing it to third parties where necessary in order to provide the walk or where required by law. Muddy Boots will store and process your data in accordance with the General Data Protection Rules (2018) and we will not use your information for any purposes not connected with your booking with Muddy Boots.
7. Complaints
In the unlikely event that you should want to make a complaint about any part of your experience with Muddy Boots, you should raise the issue as soon as possible with your walk leader. If you remain dissatisfied, you must notify Muddy Boots in writing as soon as possible and, in any case, within 14 days after the walk.
